Mental Health Act as it pertains to Professional Medical Responders in BC.
As a Professional Medical Responder licensed through EMALB in the Province of British Columbia, you are subject to all the local rules and legislation, including the Mental Health Act.
Section 28 of the Mental Health Act is the most relevant and pertinent to your duties as an Emergency Medical Responder or First Responder. This section stipulates that a Police Officer has the authority to restrain and/or detain someone if the Officer determines that they pose an immediate threat to themselves or others. It is important to note that the language in the Mental Health Act does not extend this authority to Emergency Medical Responders or First Responders.
